1. Guarantees and After Sales Service (SPV)
1.1 Legal Guarantee of Conformity
In accordance with the provisions of Directive - 2019/771 - EN - EUR-Lex, all products sold by IPHONERY benefit from a legal guarantee of conformity that lasts two years.

The guarantee of conformity means that the products must meet the following requirements, unless due to the circumstances of the case any of them are not applicable:

a) They conform to the description made by IPHONERY and have the qualities of the product that IPHONERY has presented to you in the form of a sample or model.
b) They are suitable for the uses to which products of the same type are ordinarily intended.
c) They are suitable for any special use required by you when you have made this known to IPHONERY at the time of entering into the contract, provided that IPHONERY has admitted that the product is suitable for said use.
(d) They have the usual quality and performance of a product of the same type that you may reasonably expect, taking into account the nature of the product and, where applicable, public statements about the specific characteristics of the products made by IPHONERY, the producer or its representative, in particular in advertising or on the label. IPHONERY shall not be bound by such public statements if it was unaware and could not reasonably be expected to be aware of the statement in question, proves that said statement had been corrected at the time of the conclusion of the contract or that said statement could not have influenced the decision to purchase the product.

There shall be no liability for lack of conformity that the consumer and user knew or could not have reasonably ignored at the time of the conclusion of the contract or that originates from materials supplied by the consumer and user.

If the product does not comply with the contract, you may choose between demanding the repair or replacement of the product, unless one of these two options is objectively impossible or disproportionate (an option that, compared to the other, imposes costs on IPHONERY that are not reasonable, taking into account the value that the product would have if there were no lack of conformity, the relevance of the lack of conformity and whether the alternative form of repair could be carried out without major inconvenience to you, will be considered disproportionate).

Defects caused by negligence, knocks, improper use or handling, unsuitable voltage, incorrect installation not carried out by the authorised Technical Service when applicable, or materials subject to wear and tear due to normal use are not included.

1.2 Manufacturer's Commercial Guarantee
All products sold by IPHONERY include the official manufacturer's guarantee, which in addition to manufacturing defects also covers possible breakdowns that occur during said guarantee period.

Please note that most manufacturers have efficient repair services near your home or through their online support or even on-site at your own home. Many incidents are resolved by following the guidelines indicated in said supports without having to return the product to a technical service. We strongly recommend that you consult the documentation for your product or the manufacturer's online support where you will be given the contractual details of your warranty, troubleshooting, steps to follow, deadlines, coverage, etc.

In the event that IPHONERY manages the repair of your product with the corresponding authorized workshop of the brand, the shipping costs to our returns center will be at your expense (provided that it is not a case of lack of conformity of origin).

IPHONERY will limit itself to applying the conditions set out in the guarantees of each manufacturer.

1.3 General information on the commercial guarantees of the manufacturers, IPHONERY and the Warranty Extensions
1.3.1 The guarantees do not apply in the following cases:

• Damage caused by adaptations or adjustments (other than the usual operating adjustments) or modifications made to a product without written agreement with the manufacturer.
• Expenses related to periodic maintenance, repair or replacement of parts due to normal wear and tear. Replacement of consumables due to normal wear and tear (batteries, bulbs, fuses, deterioration of the recording or reading heads, etc.).
• Damage caused by misuse, including:
o improper use of the product o failure to follow the manufacturer's instructions regarding the use and maintenance of the product
o improper or incorrect installation of programs
• Damage caused by non-accredited persons or by the users themselves
• Damage caused by accidents, lightning, floods
